Important: by accessing or using Nanobebe US Inc. ("Nanobebe" the "Company", "We", "Our" or "Us") website https://nanobebe.com/ (the "Website"), our application Nanobébé Aura (the "Application"), products, services or any features and thereof and any content and information therein (collectively, the "Services") you consent to the terms and conditions of this Privacy Policy and consent that all Personal Information and Sensitive Information (as defined below) that you submit or that is collected or processed through or in connection with your access to or use of the Services.

This Privacy Policy explains what Personal Information and Sensitive Information we collect and process through the Services, how we collect the information, how we use the information, with whom we may share the Personal Information, the choices you may have with respect to that information, and what you should do if you have any questions or comments.

You are not legally required to provide us with Personal Information, however, access to our Application and your use of the Services requires that you provide the Personal Information. If you choose to withhold any Personal Information required, it will not be possible for you to use the Services. If you do not agree to our terms and conditions and this Privacy Policy set forth herein please do not use the Services.

The Company may, in its sole discretion, update this Privacy Policy from time to time. In the event that the Company materially changes this Policy including how it collects, processes or uses clients' personal information, the revised Privacy Policy will be uploaded on the Company's website. In this respect, you hereby agree to accept posting of a revised Privacy Policy electronically on the website as the actual notice of the Company to its clients. Any dispute over the Company's Privacy Policy is subject to this notice and the Terms and Conditions. The Company encourages you to periodically review this Privacy Policy so that you are always aware of what information the Company collects, how it uses it and to whom it may disclose it, in accordance with the provisions of this Policy.

Please note: the Services are for non-emergency purposes only. We do not carry emergency or time-critical communications to any type of hospital, medical practice, or any other kind of emergency or time-critical service. The services do not replace any emergency assistance.

Our Application is NOT a medical device and our Services are not intended to provide a medical or therapeutic diagnosis or treatment. Our Services do not diagnose, evaluate, assess, treat, or prevent any injury, pain, or physical condition, and do not provide medical advice, treatment, therapy, or assessment services. All information provided by our Company is intended to be for general informational purposes only, and is in no way intended to create a provider-patient relationship as defined by state or federal law.

1. Scope

This Privacy Policy applies to all of the services, information, tools, features and functionality available on the Application and the Services offered by the Company or its subsidiaries or affiliated companies, and covers how Personal Information that the Company collects and receives, including in respect of any use of the Services, is treated.

The camera, Aura, used in our Services (the "Camera") is used to capture video of your baby and transmit the video to your personal account through our Mobile Application. The video can be viewed in real time, or later as a recording. Through monitoring the baby and their surroundings, we are able to provide you with observational data about your baby, including respiratory rate (RPM), sleeping patterns, movement, and noise, for you to track development, and patterns, or capture other useful information.

In addition, our Services allow you to view your baby's photos, videos, and audio recordings, and the baby's environment, as well as of other individuals, such as family members and visitors, who you allow to be in the baby's surroundings, that may be recorded if, and to the extent, you allow them in your baby's surroundings (together the "Recordings").

We are the controller ("Controller") for the Personal Information we process, unless otherwise stated. For information on how to contact us, please refer to the "Contact Us" section below.

2. Personal Information We Collect

2.1. Personal Information

"Personal Information" means information that relates to an identified or identifiable person and any information or data defined as such under applicable data protection laws. Personal Information does not include de-identified, aggregated, or combined information (which includes data that is not reasonably capable of identifying you or being linked to you). (Please also see below "Sensitive Information").

The categories of Personal Information we collect depend on how you interact with us, your use of the Application and our Services, and the requirements of applicable law. For example, we may collect different information depending on whether you are using our camera and software to monitor your baby, visiting our website, or providing services to us as part of a business relationship. We collect information that you provide to us via your registration to our application, your recordings, the information we obtain automatically when you use our Services, and information from other sources such as third-party services and organizations, all as described in the chart below:

Application, Internet or other similar network activity information, such as your IP address, log-in information or information regarding your interaction with our Services, website, Application or advertisement.

Purchase Information. We collect information when you purchase our products and sign up for our Services, such as full name, email address, phone number, device information, profile image, and payment information (we do not collect or store credit card numbers, which is processed by an authorized third party vendor including billing information), date of birth/due date, records of products or services purchased or considered, purchasing or consuming histories or tendencies, and any other information that you provide.

Usage and Information collected by the Camera Recordings:

We collect information about you, your baby and other individuals, when you use our products and Application, such as full name, email address, country location, phone number, profile picture, user's time zone, domain server, IP address, photos and video and audio recording of your baby's behavior, and your baby's environment, including, sleeping patterns, RPM movement, video stream, development tracking for your baby usage information, baby name, baby profile image, baby gender, baby date of birth, and any other data that you provide/supply.

In addition, our Services allow you to view your baby's photos, video and audio recordings of the baby and the baby's environment, as well as of other individuals that may be recorded if and to the extent you allow them in your baby's surroundings.

Information Collected Automatically: We also collect Personal Information automatically when you use our Services, as provided in our Tracking Tools Policy below.

Including when you use our website and application, such as your IP address, user settings, type of device/operating system/browser used to access the Services, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), and Internet service provider. We may also automatically collect information regarding your use of our Services, such as pages that you visit before, during and after using our Services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services. In addition, we may collect information that other people provide about you when they use our Services, including information about you when they tag you.

We may also obtain your contact information from lead-generation services.

"Sensitive Personal Information" is a specific subset of personal information that includes certain government identifiers (such as social security numbers); an account log-in, financial account, debit card, or credit card number with any required security code, password, or credentials allowing access to an account; precise geolocation; contents of mail, email, and text messages; genetic data; biometric information processed to identify a consumer; information concerning a consumer's health, sex life, or sexual orientation; or information about racial or ethnic origin, religious or philosophical beliefs, or union membership.

We store the Personal Information for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

Diversity Information, such as you and your baby's ethnicity/race, physical or mental condition, gender, and of other individuals such as family members and visitors who you allow to be in the baby's surroundings covered by our Services.

Usage, Health and Sensory Information. We collect and process Sensitive Information about you, your baby and other individuals, when you use our Services and monitor sensory information about your baby's parameters such as heart rate, sleeping patterns, noise, video stream, development tracking for your baby, usage information, baby name, baby profile image, baby gender, baby date of birth, and any other data that you provide/supply.

As well as video recording of your baby's environment that may include other individuals such as family members and visitors who you allow to be in the baby's surroundings.

Precise Geolocation Information.

We may require that you enable precise location information sharing on your device for our Services to work properly but we do not collect or store your precise location other than for implementation of our Services.

2.3. De-identified and Aggregated Information

We may use Personal Information and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Services, or other analyses we create.

California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act De-identified Data Disclosure. We may use de-identified data in some instances. Nanobebe either maintains such data without attempting to re-identify it or treats such data as personal data subject to applicable law.

2.4. Nanobebe use of view recordings for research and development

Video recordings are viewed by our research and development team to improve our Services and technology. By using our Services, you are giving your express consent to use video, audio, and other information for our research and development. We use certain technologies to help provide better Services to our customers, including AI.

Our Camera is designed to protect your privacy while providing our Services. All video and monitoring are processed automatically, and stored safely, however we cannot guarantee or warrant the security of any information as further detailed in Section 6. If at any time you wish to discontinue our Services, inquire about the video and recordings being collected, or wish to have your video recordings deleted, please contact us directly at info@nanobebe.com.

3. Tracking Tools Policy

3.1. Cookies, Pixel Tags/Web Beacons, and Other Technologies

We, as well as third parties that provide content, advertising, or other functionality on our Services, may use cookies, pixel tags/web beacons, and other tracking technologies ("Technologies") to automatically collect information through your use of our Services. Cookies are small text files placed in device browsers that store preferences and facilitate and enhance your experience. A pixel tag (also known as a web beacon) is a piece of code embedded in our Services that collects information about engagement on our Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded. Our uses of these Technologies fall into the following general categories:

3.1.1. Strictly Necessary for Essential Website Purposes

This includes Technologies that allow you access to our Services, applications, and tools that are required to identify irregular website behavior, prevent fraudulent activity, and improve security or that allow you to make use of our functionality;

Our website uses a tool called "Google Analytics" to collect information about use of our Services. We use the information we get from Google Analytics to maintain and improve the Services. 3.2.2. Social Media Platforms

Our Services may contain social media buttons such as Facebook, Twitter, or Pinterest (that might include widgets such as the "share this" button or other interactive mini-programs). These features may collect your IP address, which page you are visiting on our Services, and may set a cookie to enable the feature to function properly. Your interactions with these platforms are governed by the privacy policy of the company providing it.

3.4. Cookies and Our Mobile Application

We do not use cookies in our Mobile Applications. To improve the app user experience and notify users about upcoming changes, we process information about your mobile device (e.g., model, city, and country location) and your interaction within the app.

If you download our App, we may collect information automatically to share with third parties to identify and fix performance issues, process information about your mobile device, as well as other tracking and performance data. We also may use a third party to detect app crashes, including Google LLC's Firebase Crashlytics in the U.S.—to process:

4. Disclosure of Information to Third Parties

We do not sell or otherwise share personal information about you except as described in this Privacy Policy. We disclose your information to third parties for a variety of business purposes, including to provide our Services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below, third parties we have disclosed the information to for business purposes and the purpose for the business disclosure (as provided in the chart above), within the last twelve (12) months.

We may share your Personal Information with our third-party service providers who use that information to help us provide our Services. 5. Your Privacy Choices and Rights

5.1. Your Privacy Choices

The privacy choices you may have about your Personal Information are determined by applicable law and are described below.

Email and Telephone Communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested.

Text Messages. You may opt out of receiving text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us.

Mobile Devices. We may send you push notifications through our Application. You may opt out from receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information via our mobile application. You may opt out of this collection by changing the settings on your mobile device, however such opt out may prevent our Services (in part of in full).

Cookies and Interest-Based Advertising. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. However, if you adjust your preferences, our Services may not work properly. Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt-out of personalized advertisements on some mobile applications by following the instructions for Android, iOS and others.

5.2. Your Privacy Rights

Please note that under certain circumstances and depending on your jurisdiction, you are entitled to specific rights regarding your Personal Information (subject to some exceptions).

If you are a California resident – the CPRA provides you with the following rights regarding your Personal Information: (i) you have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. (ii) the right to request that we correct Personal Information that is inaccurate. (iii) you have the right to request that we delete the Personal Information that we have collected about you. (iv) You may have certain rights over the processing of your Sensitive Personal Information. We will not discriminate against you for exercising any of your CPRA rights.

We keep your personal information to enable your continued use of our Services, for as long as it is required in order to fulfill the relevant purposes described in the charts above, as permitted or as may be required by law, or as otherwise communicated to you.

The rights described are not absolute, may vary based on the privacy laws that apply to your information, and in some instances we may decline the request as permitted by law.

6. Security of Your Personal Information

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy (e.g., we use Web Real-Time Communication in order to secure our Website and Application). Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We have taken appropriate safeguards to require that your Personal Information will remain protected and require our third-party service providers and partners to have appropriate safeguards as well. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

By accessing or using our Services or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a data breach, we may attempt to notify you electronically by posting a notice on our Services or by sending an email to you.

7. International Data Transfers

All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States, Israel, or other countries, which may have data protection laws that are different from the laws where you live.

We store the Personal Information for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws. If certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties' policies.

9. Supplemental Notice for Certain States

California Residents

California Civil Code Section 1798.83 permits customers of Company who are California residents to request certain information regarding its disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to info@nanobebe.com. Please note that we are only required to respond to one request per customer each year.

Nevada Residents

Nevada law allows customers to "opt out" of the sale of certain personal information, called "covered information." At Nanobebe, we do not sell covered information as defined in the law and we have no plans to change that practice.

10. Children's Information

Our Application and the Services are not directed to, nor intended to be operated by children under the age of 16 (or other age as required by local law), No one under age of 16 may provide any personal information to or on the Services and we do not knowingly collect Personal Information provided to us by children as customers or users of our Services.

If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us at: info@nanobebe.com.

If you are a parent or guardian and wish to review Personal Information collected about your child, or have that information modified or deleted, you may contact us as set forth below.

11. Other Provisions

Third-Party Websites or Applications. The Services may contain links to other websites or applications and other websites or applications may reference or link to our Services, or refer by the registration of a user to our Application via a third-party account (such as social media account). These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.

Supervisory Authority. If you are located in the European Economic Area, Switzerland, the United Kingdom, California or Brazil, you have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

Changes to our Privacy Policy. We may revise this Privacy Policy from time to time in our sole discretion. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on our website.
